Knomos complies with applicable Canadian legislation on privacy protection – we’re no fans of spam – and are very considerate with the safe handling of any personal information shared. That’s really all we want to say!
This means that we will share your personal information with you for the purpose of fulfilling the services and may share specific personal information with third parties engaged to assist us in providing the service requested. Under no circumstances do we share personal information with third parties without your consent, unless there is a requirement to do so by law.
Information We Collect and Store
We may collect and store the following Information when running the Knomos Services:
1. Information You Provide. When you register an account with Knomos, we start by collecting some personal information, such as your name and email address. We may also receive Personal Information (for example, your email address) through other users, for example if they have tried to share content from the Knomos Services with you or tried to refer Knomos to you.
2. Log Data on Visits. When you use the Knomos Services, we automatically record information from your Device, its software, and your activity while using the Knomos Services. This may include the Device’s Internet Protocol (“IP”) address, the operating system and web browser type, the address of the web page that referred you to our website, the query on the search engine of the referring website, search terms you submit to our website, geographic location, identification numbers associated with your Devices, date and time stamps associated with activity on the website, system configuration information, metadata concerning file you upload to Knomos’ public platform, and other interactions with the Knomos Services.
How We Use Personal Information
In the course of using the Knomos Services, we may collect personal information that can be used to contact or identify you (“Personal Information”). Personal Information is or may be used:
(a) to provide and improve the Knomos Services;
(b) to administer your use of the Knomos Services;
(c) to better understand your needs and interests;
(d) to personalize and improve your experience;
(e) to provide or offer software updates and product announcements; and
Some Devices allow applications to access real-time location-based information (for example, GPS). Also, some of the information we collect from a Device, for example IP address, can sometimes be used to approximate a Device’s location. We may use this information to optimize your experience.
We also collect some information (ourselves or using third party services) using logging and cookies, such as IP address, which can sometimes be correlated with Personal Information in the form of analytics (such as the number of visitors, pages most often visited, technology used by users, referring sites and users’ countries of origin).
We use this information for the above purposes and to monitor and analyze use of the Knomos Services (including to protect against fraud; ensure security and reliability of our Website; avoid any tampering, damages, and/or misuse of our website and resources such as abusive downloading), for the Knomos Services’ technical administration, to enhance Knomos Services’ functionality and user experience, develop new Knomos Services, develop partnerships and/or improve partnerships, and to verify users have the authorization needed for the Services to process their requests.
Content Provided By You
Knomos is a shared legal resource where users contribute content and add information, with the understanding and expectation that such content and information will be publicly accessible.
We may aggregate and display information about your publicly viewable activities on Knomos in your profile, which is also viewable by the public. For example, your profile may include commentary, annotations, files, or other content that you have contributed to the Knomos Services, as well as analytics and other metrics associated with your publication of that content and other users’ responses, up-votes, and page views relating to that content.
Information Sharing and Disclosure
The information we collect is used to provide and improve Knomos Services and content, and to prevent abuse. We do not sell your Personal Information to third parties. We may share or disclose your information with your consent, for example if you use a third-party application to access your account.
We may disclose information to parties outside Knomos about you that we collect when we have a good faith belief that disclosure is reasonably necessary to:
(a) comply with a law, regulation, or compulsory legal request;
(b) protect the safety of any person from death or serious bodily injury;
(c) prevent fraud or abuse of the Knomos Services or its users; or
(d) to protect Knomos’ property rights, including but not limited to intellectual property.
We will independently object to requests for access to information about users of our website that we believe to be excessive, unwarranted or improper.
We may disclose your non-private, aggregated, or otherwise non-personal information, such as usage statistics of the Knomos Services.
Changing or Deleting Your Information
If you are a registered user, you may review, update, correct or delete the Personal Information provided in your registration or account profile. If your personally identifiable information changes, or if you no longer desire to use the Knomos Services, you may update or delete it by making the change on your account settings. Data Retention & Management of Information
We will retain your information for as long as your account is active or as needed to provide you with the Knomos Services. If you wish to cancel your account or request that we no longer use your Personal Information to provide you the Knomos Services, you may delete your account by sending a request to delete your account to firstname.lastname@example.org.
We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Consistent with these requirements, we will try to delete your information quickly upon request. Please note, however, that there might be latency in deleting information from our servers and backed-up versions might exist after deletion. In addition, we do not delete from our servers files that you have in common with other users.
Information Contained in Public Legal Content
Knomos publishes public legal content, such as laws and court decisions, in the form in which it is received from the institutions that issue them, such as official publishers, courts and law societies. The documents are public. Knomos considers that publishing the complete documents, including the personal information they may contain, is primordial to implementing the principles of openness and transparency that govern Canadian public institutions.
With respect to court decisions, the transparency characteristic of the Canadian judicial system protects the impartiality of the judiciary, ensures the fairness of the judicial process and enables individuals to base their conduct on precedents established by judges. Knomos does not edit the content of court decisions except to comply with publication bans imposed by statutes or courts and in accordance with the policies of the institution that provided the text of the decision.
In order to limit prejudice to individuals that could result from the free publication of public legal content containing personal information, Knomos is actively involved in advancing standards and policies that promote optimal protection of the privacy of people who appear before the courts.
Indexing of Decisions by External Search Engines
Requests Concerning the Content of Published Documents
All requests concerning the content of a document published on the Knomos website should be submitted to the email@example.com. If the request is to withdraw or amend a decision, it will be studied in light of applicable rules pertaining to publication restrictions. Requests for withdrawal or amendment that are not justified by relevant legislative provisions or a court order restricting publication will be refused. Persons wishing to submit a request for withdrawal but who do not know the law applicable to their situation are asked to contact their lawyer or the registry of the court that rendered the decision.
Feedback Form and Contact Emails
When users complete the feedback form or contact us via email, it is possible for them to provide their names, organization’s name and email address. The information is used and stored only as required to process the request and to establish general statistics.
